ARTICLE 1. DEFINITIONS
In these terms and conditions, the following terms are understood to mean:

Cooling-off period: the period within which the customer can exercise their right of withdrawal; Customer: Globemilk supplies its products to associations and companies registered in the Chamber of Commerce’s Trade Register. Day: calendar day; Right of withdrawal: the opportunity for the customer to cancel the distance contract within the cooling-off period; Distance contract: a contract in which, in the context of a system for distance selling of products and/or services organized by Globemilk, only one or more techniques for distance communication are used up to and including the conclusion of the contract;

ARTICLE 3. APPLICABILITY
These general terms and conditions apply to every offer from Globemilk and to every distance contract concluded between Globemilk and the customer via Globemilk’s webshop. Before the distance contract is concluded, the text of these general terms and conditions is made available to the customer. If the customer does not agree with the general terms and conditions, no contract can be concluded between the customer and Globemilk via the webshop.

ARTICLE 4. THE CONTRACT
The contract is concluded at the moment of acceptance by the customer of the offer and compliance with the conditions set. If the customer has accepted the offer electronically, Globemilk immediately confirms receipt of the acceptance of the offer electronically. Globemilk excludes liability for any form of direct or indirect damage resulting from purchasing Globemilk in violation of existing contractual obligations.

ARTICLE 5. RIGHT OF WITHDRAWAL FOR CONSUMERS
When purchasing products, the customer, insofar as they act as a consumer as referred to in Article 6:230g of the Dutch Civil Code, has the option to dissolve the contract without giving reasons for 14 days. This cooling-off period starts the day after the customer receives the product. During the cooling-off period, the customer will handle the product and packaging carefully. If the customer exercises this right of withdrawal, the product must be returned to Globemilk in its original, unopened packaging, undamaged, and with all accessories supplied.

To exercise the right of withdrawal, Globemilk must be informed of the decision to withdraw from the contract by means of an unequivocal statement. The customer can use the model withdrawal form included in these terms and conditions but is not obliged to do so.

If the customer exercises their right of withdrawal and has met all the conditions, Globemilk will refund the amount paid, including delivery costs, as soon as possible, but no later than 14 days after receiving the returned shipment. The costs for returning the goods are the responsibility of the customer.

ARTICLE 6. COMPLAINT HANDLING

The received order must be checked immediately for visible or invisible damage. If there is visible or invisible damage to your received order, or you have a question or complaint, you can email sales@globemilk.com. You will be contacted as soon as possible about the next steps.

ARTICLE 7. THE PRICE
During the validity period stated in the offer, the prices of the offered products will not be increased. All prices are in euros and are clearly indicated on the website. Globemilk cannot be held liable for deviations in prices, images, and texts of the products as displayed and stated on the website.

The prices on the website are exclusive of VAT and exclusive of delivery costs. The VAT and delivery costs are clearly incorporated into the total price to be paid before completing an order. The delivery costs per order depend on the order size and are specified on the site.

ARTICLE 8. CONFORMITY AND WARRANTY
Globemilk ensures that the products comply with the contract, the specifications stated in the offer, reasonable requirements of reliability and/or usability, and the legal provisions and/or government regulations existing on the date the contract is concluded.

ARTICLE 9. DELIVERY AND EXECUTION
The delivery service engaged by Globemilk will exercise the utmost care when receiving and executing orders.

Delivery service for test packages is as follows; these can be expected on Friday regardless of the order day. Delivery service for paid packages is as follows; if the customer places and pays for the order from Monday to Friday before 4:00 PM, the relevant order will be delivered the next working day (also on Saturday) after receipt of payment. If the order is placed and paid for after 4:00 PM, the order will be shipped the second working day. Orders placed and paid for on Saturday or Sunday before 4:00 PM will be delivered on Tuesday. Delivery times are on weekdays from 8:00 AM to 6:00 PM. On the Wadden Islands, we do not deliver the next working day but one day later, on the second working day. A different delivery rate of 7.20 euros also applies for this.

If the customer places and pays for an order on Friday, the order will be shipped the following Monday.

Efforts are made to meet these delivery times and times, but unfortunately, we cannot guarantee the delivery times. If the delivery is delayed, or if an order cannot or can only partially be executed, the customer will be notified as soon as possible. In that case, the customer has the right to terminate the contract without costs. The delivery is carried out by an external party.

If no one is present at the agreed delivery address to whom delivery can or may be made, then in the case of a customer who is a consumer, the deliverers will try to deliver the order to the neighbors.

If delivery (to neighbors) is not possible, the products will be offered at a collection point.

All goods to be delivered are delivered and picked up on the ground floor. The loading/unloading place must be easily accessible for our vehicles or those of our carriers.

Globemilk reserves the right to change the delivery of the goods or not to deliver them at all if the delivery location seems unsafe or risky to him, with regard to any damage that may arise.

ARTICLE 10. COMPLAINTS, WARRANTY, RETURNS, AND FORCE MAJEURE
The customer must check the delivered goods on the date of delivery. Complaints must be reported to Globemilk within 24 hours, subject to forfeiture of the right to complain. From the moment of use, the customer loses the right to complain, unless it is a defect that only became apparent upon use. The foregoing does not affect the right of withdrawal of Article 6.

Any defects or incorrectly delivered goods will be exchanged or returned free of charge within 3 working days.

The customer indemnifies Globemilk against any damage claims from third parties. Globemilk also cannot be held liable for damage caused by external carriers engaged by Globemilk, unless this damage is attributable to intent or gross negligence on the part of the external carrier.

The customer is fully responsible for using the product in a proper manner, including storage.

When placing an order, the customer can disable the ‘tick’ that gives permission to send commercial emails for similar products from Globemilk (opt-out). If that does not happen, the permission granted can be withdrawn at any time.

For the processing of the order, the (personal) data of the customer and the email address will be stored in an electronic file. This file will not be sold or provided to third parties unless this is necessary for the processing of the order (for example, in connection with delivery). Globemilk ensures that the storage and processing of such data are in line with current laws and regulations.

ARTICLE 11. PAYMENT
Payment is made exclusively in advance via iDeal or credit card.

The customer will be informed about the handling of this question or complaint within a reasonable period after receipt.

ARTICLE 13. DUTCH LAW AND DISPUTE RESOLUTION
Dutch law exclusively applies to agreements between Globemilk and the customer to which these general terms and conditions relate. Any disputes directly or indirectly related to the webshop will be settled exclusively by the competent court in ‘s-Hertogenbosch.
